MINUTES
The Elmore County Commission met in Regular Session on Monday, September 25, 2023 at 5:48pm in the Elmore County Historic Courthouse Courtroom. The meeting was called to order by Chairman Mercer. Chairman Mercer gave the Invocation. Commissioner Hill led those present in the Pledge of Allegiance. The roll was called. There being present Commissioners Henry Hines, Mack Daugherty, Dennis Hill, Desirae Lewis Jackson, and Chairman Bart Mercer. The following proceedings were had to wit:
Special Presentation:
Commissioner Jackson moved to approve Firefighter Appreciation Proclamation (attachment 1). The motion was seconded by Commissioner Hill and passed unanimously.
Commissioner Daugherty moved to approve the Minutes of the September 11, 2023 Commission Meeting. The motion was seconded by Commissioner Hines and passed unanimously.
Commissioner Hines moved to approve the Memorandum of Warrants for the period of September 2, 2023 through September 15, 2023 (attachment 2). The motion was seconded by Commissioner Daugherty and passed unanimously.
Old Business:
Commissioner Hill moved to approve a 050 – Retail Beer (Off Premises Only) and 070 – Retail Table Wine (Off Premises Only) Alcohol License Application by Firetower Grocery INC for Firetower Grocery located at 3803 Firetower Road, Wetumpka, Alabama 36093 (attachment 3). The motion was seconded by Commissioner Jackson and passed unanimously.
Commissioner Hill moved to approve a 011 – Lounge Retail Liquor – Class II (Package) Alcohol License Application by Firetower Liquor INC for Firetower Liquor located at 3801 Firetower Road, Wetumpka, Alabama 36093 (attachment 4). The motion was seconded by Commissioner Hines and passed unanimously.
Commissioner Hines moved to approve a 040 – Retail Beer (On or Off Premises) and 060 – Retail Table Wine (On or Off Premises) Alcohol License Application by Sunken Tractor LLC for Sunken Tractor LLC located at 859 Mehearg Road, Wetumpka, AL 36092 (attachment 5). The motion was seconded by Commissioner Jackson and passed unanimously.
Commissioner Jackson moved to appoint Leon Smith, Jr. to the Elmore County E-911 Board. The motion died for a lack of a second. Commissioner Hines moved to appoint Cory Puckett and Oreste M. Johnson to the Elmore County E-911 Board (attachment 6). The motion was seconded by Commissioner Daugherty and passed unanimously.
Commissioner Jackson moved to appoint John Strickland, Harris Garner, Rhett Smith, and Art Faulker to the Elmore County Industrial Development Authority Board [ECIDA] (attachment 7). The motion was seconded by Commissioner Hines. Commissioner Daugherty recused himself, Commissioners Hines, Hill, Jackson, and Chairman Mercer voted in favor of the motion The motion carried.
Commissioner Hill moved to appoint Maria “Kathleen” Calhoun, Jan Wood, and Christopher B. Colley to the Elmore County DHR Board (attachment 8). The motion was seconded by Commissioner Hines. Commissioner Jackson voted against the motion. The motion carried with all other Commissioners voting in favor of the motion.
Commissioner Daugherty moved to appoint David Sturdivant to the Ridge Improvement District Board (attachment 9). The motion was seconded by Commissioner Hines and passed unanimously.
New Business:
Commissioner Hines moved to approve setting a Public Hearing on Tuesday, October 10 at 5pm for a 011- Lounge Retail Liquor – Class II (Package) Alcohol License Application by Georgia Road LLC for G Mart Liquor located at 10786 Georgia Road, Eclectic, AL 36024 (attachment 10). The motion was seconded by Commissioner Daugherty and passed unanimously.
Commissioner Jackson moved to approve amendments to FY2023 Budget (attachment 11). The motion was seconded by Commissioner Hill and passed unanimously.
Commissioner Daugherty moved to approve the Consent Docket as follows:
The motion was seconded by Commissioner Hines. Commissioner Jackson voted against the motion. The motion carried with all other Commissioners voting in favor of the motion.
Personnel Notifications:
There were no additions to the Reports to the Commission from the Work Session. There being no further business to come before the Commission, Commissioner Jackson moved to Adjourn. The motion was seconded by Commissioner Hill and passed unanimously.

Commissioner Jackson moved to approve the Minutes of the August 11, 2023 Commission Meeting. The motion was seconded by Commissioner Hill and passed unanimously.

Commissioner Jackson moved to approve FY2024 Detention Agreement with Montgomery County for two (2) detention beds (attachment 9). The motion was seconded by Commissioner Hill and passed unanimously.
Commissioner Hines moved to approve FY2024 Long-term Detention Subsidy Contract with Alabama Department of Youth Services (DYS) for one (1) detention bed (attachment 10). The motion was seconded by Commissioner Jackson and passed unanimously.
Commissioner Jackson moved to approve FY2024 Diversion Grant Agreement with Alabama Department of Youth Services (DYS) and authorize Chairman to execute agreement (attachment 11). The motion was seconded by Commissioner Hill and passed unanimously.
Commissioner Jackson moved to approve authorizing Chairman and COO to execute the Alabama Department of Environmental Management (ADEM) ARPA Drinking Water/Wastewater Project Agreement and any other associated documents to facilitate the West Elmore Sewer Group project. This item includes the necessary budget amendments to handle this expenditure (attachment 12). The motion was seconded by Commissioner Hill and passed unanimously.
Commissioner Daugherty moved to approve authorizing Chairman and COO to execute the GMC Master Service Agreement and Task Order to facilitate the West Elmore Sewer Group project. This item includes the necessary budget amendments to handle this expenditure (attachment 13). The motion was seconded by Commissioner Hill and passed unanimously.
Commissioner Hines moved to approve modifications to the ARP Allocation Plan (attachment 14). The motion was seconded by Commissioner Jackson and passed unanimously.
Commissioner Jackson moved to approve releasing $68,956.12 in unclaimed funds held over 10 years in the County Fiduciary Account to the General Fund (attachment 15). The motion was seconded by Commissioner Hill and passed unanimously.
Commissioner Hines moved to approve authorizing Chairman to execute Interagency Cooperative Agreement with the Alabama Department of Environmental Management (ADEM) for the remediation of solid waste along the County right of way (attachment 16). The motion was seconded by Commissioner Daugherty and passed unanimously.
Commissioner Hines moved to approve awarding FY2024 Annual Competitive and Public Works Bid Inquiries in the attached spreadsheet to the lowest responsible bidders (attachment 17). The motion was seconded by Commissioner Hill and passed unanimously.
Commissioner Hines moved to approve authorizing Chairman to execute Construction Agreement with ALDOT for the resurfacing and traffic stripe of First Avenue from SR-143 to Baltzer Road and on Baltzer Road from First Avenue to Flatwood Road, Project #STPMN-2621 (253) [Formerly CRSAMN-3621] (attachment 18). The motion was seconded by Commissioner Hill and passed unanimously.
Commissioner Daugherty moved to approve authorizing Chairman to execute Construction Agreement with ALDOT for slope repairs and shoulder repairs on Redland Road, FHWA Disaster #AL 2023-02; DDIR #Elmore-01: ALDOT Event 055; ER-9075( ); ERPR-9075 [ ] (attachment 19). The motion was seconded by Commissioner Hines and passed unanimously.
Commissioner Hill moved to approve setting a Public Hearing on Monday, October 23, 2023 at 5pm for the proposed vacation of a portion of Maverick Circle by the adjoining land owners (attachment 20). The motion was seconded by Commissioner Daugherty and passed unanimously.

Commissioner Daugherty moved to approve the Resolution recognizing the Tallassee City School Anglers as 2023 State Champions and 2023 Smallmouth Division Team of the Year by the Alabama Student Angler Bass Fishing Association [ASABFA] (attachment 2). The motion was seconded by Commissioner Jackson and passed unanimously.
Commissioner Hines moved to approve the Resolution recognizing the Wetumpka Baseball 14U All-Star Team as the 2023 USSSA Silver Bracket World Series Champions (attachment 3). The motion was seconded by Commissioner Jackson and passed unanimously.
Regular Business:
Commissioner Hill moved to approve the Minutes of the July 27, 2023 Commission Meeting. The motion was seconded by Commissioner Daugherty and passed unanimously.

July 16, 2023 through August 4, 2023 (attachment 4). The motion was seconded by Commissioner Jackson and passed unanimously.

Approval of the budget includes pay rate changes for positions, employee pay increases, new and revised job descriptions, the SRO cost share program, the Retiree Healthcare Incentive and authorization for the Chairman to execute included contracts and/or addendums (attachment 8). The motion was seconded by Commissioner Jackson and passed unanimously.
Commissioner Jackson moved to approve authorizing Chairman and COO to execute the necessary documents to purchase approximately eleven (11) acres immediately north of the Elmore County Judicial Complex and necessary budget amendments to handle the purchase (attachment 9). The motion was seconded by Commissioner Hill and passed unanimously.
Commissioner Hines moved to approve three-year service contract with Johnson Controls for HVAC system at the Elmore County Public Works Department (attachment 10). The motion was seconded by Commissioner Daugherty and passed unanimously.

Commissioner Hines moved to approve Resolution to join other counties in applying for planning grant through the USDOT’s Bridge Investment Program (attachment 4). The motion was seconded by Commissioner Daugherty and passed unanimously.
Commissioner Hines moved to approve Resolution to join other counties in applying for Safe Streets and Roads for All (SS4A) grant funding to create a comprehensive safety action plan (attachment 5). The motion was seconded by Commissioner Jackson and passed unanimously.
Commissioner Jackson moved to approve awarding Bid Inquiry 2023-23 Heavy Duty Polypropylene Pipe (Grey Pipe) to the lowest responsible bidder (attachment 6). The motion was seconded by Commissioner Hill and passed unanimously.

Chief Operations Officer, Richie Beyer, explained to those in attendance that this is where he would normally give an update on ongoing projects and updates for the Commission that are noteworthy to be shared in the different districts and media.

Commissioner Hines thanked everyone for coming and participating. Hines congratulated all the ball teams and individuals recognized today and stated that team stands for – Together Everyone Achieves More. Commissioner Hines mentioned Elmore County’s Spring Cleanup and thanked those who participated, 25 different teams/groups, as well as our Public Works Department. Hines stated that life is a moment, takes one to two seconds to ruin that moment with one decision you make good or bad, choose correctly. Be a leader for the community. Pick a career, not a job. Be a good citizen, a good student, and respect your parents.
Commissioner Daugherty encouraged everyone to register to vote if they haven’t already registered. If you think, “my vote won’t matter,” remember the state legislative race in the last election in Auburn came down to one vote. One vote can win the race, one vote made the difference in thousands of votes. Your vote matters! Commissioner Daugherty stated that we are blessed in Elmore County, we are one of the fastest growing counties in the state of Alabama. Daugherty explained that we have one of the best law enforcement communities in the state, he has been a part of it for over 38 years. Also, Elmore County has one of the best educational systems in the state. He stated that he is so proud of the students and what you can accomplish in the future.
Commissioner Hill reminded everyone that tomorrow at 10:00am is the third annual Ability Games at the Wetumpka Sports Complex, come out and support this. Hill stated that he is proud of the athletic teams in Elmore County, seems like we are constantly honoring them. Commissioner Hill said that his emphasis on the Commission is education, he is a product of Elmore County Schools. Hill echoed his fellow Commissioners by the blessing we have with our schools and with the Elmore County Technical Center. Commissioner Hill told the students he is the newest County Commissioner, appointed by Governor Kay Ivey in November 2022 to replace Troy Stubbs who is in the House of Representatives. Become educated on how government works, make up your mind now to get involved and make government work how it needs to.
Commissioner Jackson said while Commissioner Hill is the newest Commissioner, she is the youngest on the Commission. She stated you can do what the five Commissioners are up here doing. Commissioner Jackson encouraged the students to see all that Elmore County has to offer while here today, and you can sit in this seat, get involved in County government, help the community because there is no limit to what you can achieve. Jackson wished the seniors the best, congratulated the sports teams and stated that the Commission is honored to recognize them.
Chairman Mercer stated that it is a great honor to serve with such a great group on this Commission, and he appreciates all they do for the citizens in the County.

Under Additional Reports to the Commission from the Work Session, Chairman Mercer thanked his fellow Commissioners and appreciates the opportunity to serve in this capacity. He thanked Commissioner Stubbs for the great job he has done serving the County for the last six years as Chairman and looks forward to him representing us in the legislature. Commissioner Henry Hines thanked the residents for participating in the Fall Cleanup. Several hundred bags of trash were collected from the residents and youth groups that got out and cleaned up. He looks forward to the Spring Cleanup when we can hopefully double or triple the number of volunteers. Commissioner Hines also stated that Veterans Day is coming up, find someone who served and have given us the right to vote, and thank them.
