MINUTES
The Elmore County Commission met in Regular Session on Monday, September 26, 2022 at 5:27pm in the Elmore County Historic Courthouse Courtroom. The meeting was called to order by Chairman Stubbs. Chairman Stubbs gave the Invocation. Commissioner Hines led those present in the Pledge of Allegiance. The roll was called. There being present Commissioners Henry Hines, Mack Daugherty, Bart Mercer, and Chairman Troy Stubbs. Commissioner Desirae Lewis Jackson joined via teleconference. A quorum was physically present at the meeting. Commissioner Jackson was unable to be physically present due to illness and opted to participate electronically in accordance with county policy and Act #2022-421. The following proceedings were had to wit:
Regular Business:
Commissioner Jackson moved to approve the Minutes of the September 12, 2022 Commission Meeting. The motion was seconded by Commissioner Hines and passed unanimously.
Commissioner Mercer moved to approve the Memorandum of Warrants for the period of August 27, 2022 through September 16, 2022 (attachment 1). The motion was seconded by Commissioner Daugherty and passed unanimously.
Old Business:
Commissioner Hines moved to appoint Steve R. Forehand to The Ridge Improvement District Board (attachment 2). The motion was seconded by Commissioner Jackson and passed unanimously.
Commissioner Mercer moved to appoint Sharon Alexander, John Strickland, Harris Garner, Rhett Smith, and Art Faulkner to the Elmore County Industrial Development Authority Board (attachment 3). The motion was seconded by Commissioner Hines. Commissioner Daugherty recused himself, Commissioners Hines, Mercer, Jackson and Chairman Stubbs voted in favor of the motion. The motion carried.
New Business:
Commissioner Daugherty moved to approve setting a public hearing on Tuesday, October 11 at 5pm for a 050 – Retail Beer (off premises only) Alcohol License Transfer Application from Holley Mart 6 to G Mart by Georgia Road LLC at 10790 Georgia Road, Eclectic, AL 36024 (attachment 4). The motion was seconded by Commissioner Mercer and passed unanimously.
Commissioner Hines moved to approve amendments to the FY2022 Budget (attachment 5). The motion was seconded by Commissioner Daugherty and passed unanimously.
Commissioner Mercer moved to approve the resolution to resurface and traffic stripe Willow Springs Road from Jasmine Hill Road east 1.931 miles to Redland Road, ECP 26-61-22 (attachment 6). The motion was seconded by Commissioner Hines and passed unanimously.
Personnel Notifications:
There were no additions to the Reports to the Commission from the Work Session. There being no further business to come before the Commission, Commissioner Jackson moved to Adjourn. The motion was seconded by Commissioner Mercer and passed unanimously.

The Elmore County Commission met in Regular Session on Monday, September 12, 2022 at 5:48pm in the Elmore County Historic Courthouse Courtroom. The meeting was called to order by Chairman Stubbs. Commissioner Daugherty gave the Invocation. Commissioner Mercer led those present in the Pledge of Allegiance. The roll was called. Special Presentation:
Commissioner Jackson moved to approve the Constitution Week Proclamation (attachment 1). The motion was seconded by Commissioner Daugherty and passed unanimously.
Regular Business:
Commissioner Daugherty moved to approve the Minutes of the August 8, 2022 Commission Meeting. The motion was seconded by Commissioner Mercer and passed unanimously.
Commissioner Hines moved to approve the Memorandum of Warrants for the period of July 30, 2022 through August 26, 2022 (attachment 2). The motion was seconded by Commissioner Daugherty and passed unanimously.
Old Business:
Commissioner Hines moved to approve the proposed vacation by adjoining land owner of a section of Providence Road (attachment 3). The motion was seconded by Commissioner Jackson and passed unanimously.
Commissioner Mercer moved to approve the County Commission redistricting map (attachment 4). The motion was seconded by Commissioner Daugherty and passed unanimously.
Commissioner Jackson moved to appoint J. Pratt Austin-Trucks to the Community Action Partnership of Middle Alabama Board (attachment 5). The motion was seconded by Commissioner Mercer and passed unanimously.
New Business:
Commissioner Hines moved to approve the appointment of Commissioner Desirae Lewis Jackson as the Commission representative to the Mid-South RC&D Council (attachment 6). The motion was seconded by Commissioner Daugherty and passed unanimously.
Commissioner Jackson moved to approve the revised ARP Allocation Plan (attachment 7). The motion was seconded by Commissioner Daugherty and passed unanimously.
Commissioner Mercer moved to approve the FY2023 Humane Society of Elmore County Contract (attachment 8). The motion was seconded by Commissioner Jackson and passed unanimously.
Commissioner Daugherty moved to approve authorizing Chairman to execute dispatch agreements for municipalities and the County E911 Board (attachment 9). The motion was seconded by Commissioner Hines and passed unanimously.
Commissioner Jackson moved to approve the FY2023 Diversion Grant Agreement with Department of Youth Services (DYS) and authorize Chairman to execute agreement (attachment 10). The motion was seconded by Commissioner Hines and passed unanimously.
Commissioner Mercer moved to approve authorizing Chairman to execute Revenue Department Digital Information Cooperative Mapping Agreement with Alabama Department of Transportation [ALDOT] (attachment 11). The motion was seconded by Commissioner Jackson and passed unanimously.
Commissioner Hines moved to approve authorizing COO to execute new three-year lease agreement for copiers off state contract for Commission Office, Mapping Department and EMA Office (attachment 12). The motion was seconded by Commissioner Daugherty and passed unanimously.
Commissioner Mercer moved to approve a Petition for Reimbursement of Excess Funds from Tax Sale of Real Property by Charles R. Reed II for 29-07-09-32-0-000-008.004 (attachment 13). The motion was seconded by Commissioner Daugherty and passed unanimously.
Commissioner Jackson moved to approve the Investing in Alabama Counties (IAC) recommendations to accept bids for digitization of records, personal protective equipment, and COVID-19 testing kits and services (attachment 14). The motion was seconded by Commissioner Mercer and passed unanimously.
Commissioner Hines moved to approve awarding FY2023 Annual Competitive and Public Works Bid Inquiries in the attached spreadsheet to the lowest responsible bidders (attachment 15). The motion was seconded by Commissioner Daugherty and passed unanimously.
Commissioner Mercer moved to approve the Consent Docket as follows:

Commissioner Daugherty moved to approve the Proclamation for H.O.M.E.S Day: Home Ownership Means Economic Success (attachment 2). The motion was seconded by Commissioner Jackson and passed unanimously.
Regular Business:
Commissioner Mercer moved to approve the Minutes of the July 28, 2022 Commission Meeting. The motion was seconded by Commissioner Hines and passed unanimously.
Commissioner Jackson moved to approve the Memorandum of Warrants for the period of July 16, 2022 through July 29, 2022 (attachment 3). The motion was seconded by Commissioner Mercer and passed unanimously.
Old Business:
Commissioner Hines moved to approve the proposed vacation by adjoining land owner of an unnamed road off Hickory Hill in Woodhaven Subdivision (attachment 4). The motion was seconded by Commissioner Mercer and passed unanimously.

Commissioner Hines moved to approve the Domestic Violence Grant Application and authorize Chairman to execute (attachment 5). The motion was seconded by Commissioner Jackson and passed unanimously.
Commissioner Mercer moved to approve FY2023 Detention Agreement with Montgomery County for (2) detention beds
(attachment 6). The motion was seconded by Commissioner Daugherty and passed unanimously.
Commissioner Jackson moved to approve FY2023 Detention Contract with Department of Youth Services (DYS) for (1) detention bed (attachment 7). The motion was seconded by Commissioner Daugherty and passed unanimously.
Commissioner Hines moved to approve the Resolution Approving Execution of Opioid Litigation Settlement documents
(attachment 8). The motion was seconded by Commissioner Jackson and passed unanimously.
Commissioner Jackson moved to approve the Resolution Opting Into Electronic Meeting Participation (attachment 9). The motion was seconded by Commissioner Mercer and passed unanimously.
Commissioner Hines moved to approve the FY 23 Budget (attachment 10). The motion was seconded by Commissioner Jackson and passed unanimously.
Commissioner Mercer moved to approve the advertising of a Public Hearing to consider the County Commission redistricting map at the September 12, 2022, regularly scheduled County Commission meeting at 5:00pm (attachment 11). The motion was seconded by Commissioner Jackson and passed unanimously.
Commissioner Daugherty moved to approve the Petition for Reimbursement of Excess Funds from Tax Sale of Real Property by Jill Christine Franklin for 29-13-06-23-0-001-009.001 (attachment 12). The motion was seconded by Commissioner Hines and passed unanimously.
Commissioner Hines moved to approve setting a Public Hearing on Monday, September 12, 2022 at 5:00pm for the proposed vacation of a section of Providence Road by the adjoining land owner (attachment 13). The motion was seconded by Commissioner Daugherty and passed unanimously.
Commissioner Jackson moved to approve authorizing the Chairman to execute Construction Agreement to resurface Cobbs Ford Road/Alabama River Parkway from South Edgewood Road east to Jackson Lake Road, Project #STPMN-2620 (258), ECP 26-48-21 (attachment 14). The motion was seconded by Commissioner Hines and passed unanimously.

Commissioner Mercer moved to approve authorizing the Chairman to execute an agreement with the Alabama Department of Environmental Management (ADEM) for the collection, management, disposal and/or offering for beneficial use of discarded tires and regulated solid waste (attachment 4). The motion was seconded by Commissioner Hines and passed unanimously.

The motion was seconded by Commissioner Hines and passed unanimously.
Commissioner Mercer moved to approve joint resurfacing project with the City of Millbrook to complete the resurfacing of Oak Lane and McAdams Road. County reimbursing city for resurfacing costs related to the county’s portion of McAdams (attachment 6). The motion was seconded by Commissioner Hines and passed unanimously.
Commissioner Mercer moved to approve FY 23 Commission Meeting Dates (attachment 7). The motion was seconded by Commissioner Daugherty and passed unanimously.

Commissioner Hines moved to appoint Conrad White to the Central Elmore Water and Sewer Authority Board (attachment 2). The motion was seconded by Commissioner Mercer and passed unanimously.

Commissioner Hines moved to approve the county’s participation in a joint project with the City of Wetumpka, Elmore County Board of Education, and ALDOT to install traffic signal and right turn lane at the intersection of Chapel Road and AL 14 (attachment 4). The motion was seconded by Commissioner Jackson and passed unanimously.
Commissioner Mercer moved to approve authorizing Chairman to execute construction agreement to widen, resurface and stripe on Marion Spillway from Ingram Road to SR 143, Project #CRSAMN-2621 ( ), ECP 26-53-22 (attachment 5). The motion was seconded by Commissioner Hines and passed unanimously.
Commissioner Hines moved to approve authorizing Chairman to execute construction agreement to resurface and stripe on First Avenue from SR 143 to Baltzer Road (Site 1) and on Baltzer Road from First Avenue to Flatwood Road (Site 2), Project #CRSAMN-2621
( ), ECP 26-51-22 (attachment 6). The motion was seconded by Commissioner Jackson and passed unanimously.
Commissioner Jackson moved to approve authorizing Chairman to execute construction agreement to resurface, stripe and widen to complete the bicycle/pedestrian accommodations on Chapman Road from SR-143 to the Millbrook City Limits and intersection improvements at Chapman Road and Airport Road, Project #CRSAMN-2621 ( ), ECP 26-52-22 (attachment 7). The motion was seconded by Commissioner Mercer and passed unanimously.

Commissioner Daugherty moved to approve authorizing Chairman to execute West Elmore Sewer Group Compact (attachment 5). The motion was seconded by Commissioner Hines and passed unanimously.
Commissioner Jackson moved to approve one-time lump sum payment for retirees per Act 2022-229 (attachment 6). The motion was seconded by Commissioner Hines and passed unanimously.
Commissioner Jackson moved to approve authorizing Chairman to execute Development and Land Use Agreement for Hohenberg Field Complex upon review by County Attorney (attachment 7). The motion was seconded by Commissioner Daugherty and passed unanimously.
Commissioner Mercer moved to approve budget amendment to allocate $30,000 to Grandview YMCA for expenditures related to 17 Springs Phase I (attachment 8). The motion was seconded by Commissioner Jackson and passed unanimously.

Commissioner Jackson moved to approve Petition for Reimbursement of Excess Funds from the Tax Sale of Real Property by Nelson Mullins Riley & Scarborough LLP to HGM Holdings, LLC for 29-15-04-17-0-003-014.000 (attachment 9). The motion was seconded by Commissioner Mercer and passed unanimously.
Commissioner Hines moved to approve Resolution to widen, resurface, and traffic stripe on Marion Spillway from Ingram Road east 1.87 miles to AL 143 (attachment 10). The motion was seconded by Commissioner Daugherty and passed unanimously.
Commissioner Hines moved to approve Resolution to resurface, and traffic stripe on First Avenue from AL 143 east 0.28 miles to Baltzer Road and on Baltzer Road from First Avenue north 1.88 miles to Flatwood Road (attachment 11). The motion was seconded by Commissioner Jackson and passed unanimously.

Regular Business:
Commissioner Lewis moved to approve the Minutes of the November 22, 2021 Commission Meeting as presented during the Work Session. The motion was seconded by Commissioner Hines and passed unanimously.
Commissioner Hines moved to approve the Memorandum of Warrants for the period of November 18, 2021 through December 8, 2021 (attachment 1). The motion was seconded by Commissioner Mercer and passed unanimously.
Old Business:
Commissioner Lewis moved to appoint Samuel C. Turner to the Elmore County Health Care Authority Board (attachment 2). The motion was seconded by Commissioner Daugherty and passed unanimously.

Commissioner Hines moved to approve authorizing Chairman and COO to execute Resolution
12-13-2021-1 to serve as the awarding authority for the ACCA’s Investing in Alabama Counties (IAC) Joint Bidding Program (attachment 3). The motion was seconded by Commissioner Mercer and passed unanimously.
Commissioner Lewis moved to approve authorizing Chairman and COO to execute Resolution

Commissioner Mercer moved to approve Richie Beyer, Chief Operations Officer, as Program Director for the County’s ARP allocation (attachment 5). The motion was seconded by Commissioner Lewis and passed unanimously.
Commissioner Daugherty moved to approve a resolution and policy to establish a temporary premium pay program for eligible County employees as an expenditure of the County’s ARP allocation (attachment 6). The motion was seconded by Commissioner Hines and passed unanimously.
Commissioner Lewis moved to approve compensating requesting employees for annual leave balances in excess of 240 hours during the month of January 2022 to reduce balances acquired due to the COVID-19 pandemic. The motion was seconded by Commissioner Mercer and passed unanimously.
Commissioner Hines moved to approve local legislation to revise the distribution of the special sales tax in the Elmore County portion of Prattville (attachment 7). The motion was seconded by Commissioner Daugherty and passed unanimously.
Commissioner Lewis moved to approve authorizing Chairman and COO to execute necessary documents to assist the City of Wetumpka with Master Planning for the Hohenberg and Wetumpka Sports Complex facilities. County to participate in up to 50% of the costs of the master plan and design work (attachment 8). The motion was seconded by Commissioner Hines and passed unanimously.
Commissioner Daugherty moved to approve authorizing Chairman and COO to execute three-year service plan with Johnson Controls for Elmore County Jail Boilers (attachment 9). The motion was seconded by Commissioner Hines and passed unanimously.
Commissioner Hines moved to approve contract addendum with Keet Consulting Services, LLC (KCS) to implement ArcGIS fabric parcel conversion and enterprise portal. Item to include necessary budget amendments for the expenditure from Revenue project funds (attachment 10). The motion was seconded by Commissioner Daugherty and passed unanimously.
Commissioner Lewis moved to approve Sheriff to execute three-year leases for Sheriff Department copiers off State Contract (attachment 11). The motion was seconded by Commissioner Hines and passed unanimously.
Commissioner Daugherty moved to approve the resolution to install guardrail, end anchors and pavement markers on Claud Fleahop Road from Alabama Highway 14 east 2.84 miles to South Fleahop Road (attachment 12). The motion was seconded by Commissioner Mercer and passed unanimously.
Commissioner Hines moved to approve setting a public hearing at 5:00pm on Monday, January 24, 2022 to consider the proposed vacation by adjoining land owner of a portion of Providence Road (attachment 13). The motion was seconded by Commissioner Daugherty and passed unanimously.

Commissioner Daugherty moved to approve authorizing Chairman and/or COO to execute necessary documents to provide a $400,000 reimbursement to the City of Tallassee from the Elmore County allocation of American Rescue Plan (ARP) funds for the city’s eligible items of work for the restoration of the downtown Tallassee water tank. Approval includes the necessary budget amendments to handle this expenditure. The motion was seconded by Commissioner Lewis and passed unanimously.
